The Department of Health and Human Services is, by funding scale, the Cabinet department with the largest direct exposure to the University of Minnesota institutional architecture. **The Portfolio Issue.** HHS administers federal funding for the Minnesota Medical Assistance program through CMS. Under that funding stream, the Early Intensive Developmental and Behavioral Intervention (EIDBI) benefit grew 700% between 2019 and 2024, reaching $342 million in annual cost; the Housing Stabilization Services (HSS) benefit reached $108 million per year against an original projection of $2.6 million — 4,054% over projection; and the Personal Care Assistance, Adult Day, Child Care Assistance, and non-emergency transport programs together account for the balance of the $9 billion fraud estimate documented by the House Oversight Committee's March 4, 2026 report. As of December 18, 2025, six additional defendants were charged ($20M autism + $5.65M HSS); the House Oversight investigation has documented 98 charged individuals across the EIDBI/HSS architecture, with 60+ convicted and additional indictments preparing per May 2026 reports. The training pipeline for the developmental pediatricians, child psychologists, and applied-behavior-analysis clinicians who produce these evaluations is anchored at the University of Minnesota Medical School and the affiliated UMN College of Education and Human Development. The 700% EIDBI growth between 2019 and 2024 is, in significant part, the operational output of a credentialing pipeline UMN trains. The House Oversight Committee has documented that a substantial portion of that growth involved fabricated diagnoses by paid evaluators operating through provider entities — typically LLCs in strip-mall storefronts — that bill DHS at fee-for-service rates that can exceed $200,000 per child per year. https://www.med.umn.edu/ **The University of Minnesota Origin — Funding Architecture.** The federal Medicaid expansion and NIH appropriations frameworks were substantially built during Hubert H. Humphrey's Senate career (1949-65, 1971-78). Senator Humphrey was a graduate of the University of Minnesota (B.A. 1939, summa cum laude). The Humphrey School of Public Affairs credentials the policy class that has staffed Minnesota DHS and the related state-level Medicaid administrative apparatus for four decades. https://www.hhh.umn.edu/ **The Markingson Case — Clinical-Trial Ethics Failure.** On May 8, 2004, Dan Markingson committed suicide while enrolled in a clinical trial of antipsychotic medications at the University of Minnesota Department of Psychiatry. He had been involuntarily committed and was on a stay-of-commitment order that conditioned his liberty on participation in the trial. His mother repeatedly warned trial staff that he was deteriorating; the warnings were not acted on. The University investigated itself multiple times and cleared itself. External investigation came only through the Minnesota Legislative Auditor's October 2015 report, which documented systematic problems with the University's human-subjects research program. The 42 C.F.R. In October 2025, the University signed an Office for Civil Rights Resolution Agreement acknowledging that its PhD Project partnership violated Title VI by discriminating against white and Asian students. CMS, HHS-OIG, and OHRP are the principal HHS components engaged. The §43A.191 federal complaint by the DOJ Civil Rights Division operates on a three-judge-panel + direct SCOTUS appeal track. The HHS-Education Title IX referral to DOJ is the parallel Civil Rights file. The Task Force suspension of over 200 hospice and healthcare providers in California, announced in April 2026, demonstrates the operational reach the framework can apply in Minnesota. https://www.whitehouse.gov/presidential-actions/2026/03/establishing-the-task-force-to-eliminate-fraud/ **The Ask.** I respectfully request that the Department of Health and Human Services: 1. **Apply Task Force authority** to suspend or condition CMS funding to the Minnesota Department of Human Services across the fourteen-plus high-fraud Medicaid programs, with the EIDBI, HSS, and PCA programs as the priority subjects; 2. **Audit the clinical-evaluator credentialing pipeline** for the EIDBI program in coordination with the University of Minnesota Medical School and the Minnesota Board of Medical Practice, in light of the documented fabricated-diagnosis pattern; 3. **Reopen the Markingson case review** under the OHRP framework, treating the Minnesota Legislative Auditor's October 2015 findings, the University's October 2025 Title VI Resolution Agreement, and the April 2023 Truth Report admission as material institutional facts that warrant reconsideration of the prior clearance findings; 4. **Coordinate the Title IX referral** with the Department of Justice under the Task Force framework, treating the §43A.191 challenge, the Cities Church indictment, the EIDBI fraud docket, and the Title IX matter as one coordinated matter; and 5. **Report findings to the Task Force to Eliminate Fraud** under the March 16, 2026 Executive Order coordination framework.
