# Hennepin County Board
*Seven-member governing body of Hennepin County, Minnesota, which funds two separately elected law-enforcement offices it cannot remove.*
The Hennepin County Board is the governing body of Hennepin County, [[Minnesota]]. Its seven commissioners are elected by district to four-year nonpartisan terms.[^1] The Sheriff and the County Attorney are elected separately. The medical examiner, the auditor-treasurer and the recorder are appointed by the board.[^1]
The board's authority over the Sheriff was tested in 2021–2022. Sheriff David Hutchinson crashed a government vehicle and pleaded guilty to fourth-degree DWI.[^2] On January 7, 2022, five of the seven commissioners publicly called for his resignation. The Star Tribune reported that "the board has no authority to remove him from office."[^3] Hutchinson served his full term to January 2023.[^4] The record does not establish why the county's offices were divided between elected and appointed holders, and this article does not infer a reason.
At the state level, the [[United States Department of Justice]] issued release No. 26-21 on January 14, 2026, titled *United States Department of Justice Files Lawsuit Against Minnesota's 'Affirmative Action' Regime*. Attorney General Pamela Bondi certified the case as a matter of general public importance.[^5] The release, as carried in this record, is directed at the State and does not name the county board.[^5]
## Who
The board has seven commissioners, each elected by district to a four-year nonpartisan term.[^1] Hill and Lake Press puts each district at roughly 180,000 to 185,000 residents.[^6]
The Sheriff and County Attorney hold office by separate election. The medical examiner, auditor-treasurer and recorder hold office by board appointment.[^1] In 2021–2022 the Sheriff was David Hutchinson.[^2]
## What
On January 7, 2022, five of the seven commissioners publicly called for Sheriff Hutchinson to resign. According to the Star Tribune, "the board has no authority to remove him from office" because the sheriff is an elected official.[^3]
## When
- **December 8, 2021.** At about 2:30 a.m., Hutchinson crashed his government-issued SUV. FOX 9 reported that he was travelling at about 120 mph, was not wearing a seatbelt, and had a blood alcohol content of 0.13.[^2]
- **December 16, 2021.** Hutchinson pleaded guilty to fourth-degree DWI.[^2]
- **January 7, 2022.** Five of seven commissioners called for his resignation. The Star Tribune reported that the board lacked authority to remove him.[^3]
- **February 2, 2022.** Hutchinson announced he would not seek re-election but would not leave early. He said: "I refuse to be pushed out of my role as sheriff by political figures with alternative motives."[^4]
- **January 2023.** Hutchinson's term ended. He had served it in full.[^4]
## Where
The crash occurred on Interstate 94 near Alexandria. Hutchinson entered his guilty plea in Douglas County.[^2]
## How
Under the county's structure, the board appropriates funds for the Sheriff's and County Attorney's offices. Because both officers are elected, they are not subject to removal by the board.[^1][^3] The three board-appointed offices — medical examiner, auditor-treasurer and recorder — have no arrest or charging power.[^1]
Ramsey County, the neighbouring county, is organized differently. Minnesota House Research's *Options in County Government* records that Ramsey's seven-member Board of Commissioners was established in 1974. A 1987 special law authorized a charter commission, and Ramsey voters approved a home rule charter in 1990.[^7] The project's Ramsey County history describes that charter as making Ramsey the only home rule charter county in Minnesota.[^7]
## How much
- Hutchinson agreed to pay Hennepin County $47,000 for the wrecked squad vehicle.[^8]
- KARE 11 reported his sentence: 90 days stayed, a $610 fine, and two years of probation with chemical-assessment and abstinence conditions. The formal sentencing date is not stated in the reachable sources.[^9]
- The project's at-issue record, drawing on Hill and Lake Press, states that the board's oversight approaches $5 billion when the public hospital is counted.[^6] Over that span, the board has no removal power over the Sheriff or the County Attorney.[^1][^3]
## How many
- Seven commissioners sit on the board.[^1]
- Five of the seven called for the Sheriff's resignation on January 7, 2022.[^3]
- Two county offices are separately elected and three are board-appointed.[^1]
## In the at-issue record
**[[At issue 051 - On January 7, 2022, five of Hennepin County's]]**
This entry records that five of seven commissioners called for the Sheriff's resignation on January 7, 2022, and that the board had no authority to remove him.[^3] He then served until his term ended in January 2023.[^4] The project pairs the entry with a March 2025 presidential action on information silos.[^10]
**[[At issue 054 - Hennepin County's Sheriff and County Attorney are separately]]**
This entry sets the board-appointed offices beside the two elected offices that hold arrest and charging power. Neither elected office is subject to removal by the board.[^1][^3] It carries the same presidential-action anchor.[^10]
**[[At issue 056 - Counting the public hospital, the Hennepin County board's]]**
This entry sets the board's oversight, which approaches $5 billion when the public hospital is counted, against its lack of removal power over the officers who arrest and charge.[^6][^1] The project pairs it with a March 2025 presidential action on federal payment integrity.[^11]
