# Minnesota Department of Transportation 2022-2024 Affirmative Action Plan
*Minnesota state agency affirmative action plan*
The *Minnesota Department of Transportation 2022-2024 Affirmative Action Plan* is an [[Affirmative action]] plan issued under the name of a [[Minnesota]] state agency for the period 2022 to 2024. The plan document itself is not in the record assembled for this article. A Wikipedia page under this title exists, but it carried no section text when it was retrieved on 26 October 2026.[^1] The record therefore does not establish the plan's contents, its adoption or effective dates, its signatories, or the statute under which it was issued.
The record does establish the federal action now pending against the State's affirmative-action hiring framework. On 14 January 2026 the United States filed [[United States v. State of Minnesota (0:26-cv-00273)]] in the District of Minnesota under [[Title VII]] of the [[Civil Rights Act of 1964]].[^2] The complaint cites [[Minn. Stat. § 43A.191]] eight times.[^2] The record does not establish whether the complaint names this plan or the Department of Transportation.
The [[United States Department of Justice]] announced the suit in release No. 26-21, titled *United States Department of Justice Files Lawsuit Against Minnesota's 'Affirmative Action' Regime*.[^3] The project's catalogue of U.S.-government "regime" usages (*[[How Minnesota Got Here]]*, note 40) finds Minnesota the only U.S. state so described. That is the project's own finding and has not been independently established.[^4]
## Federal action against the State
### The complaint
The United States brought No. 0:26-cv-00273 under Title VII, and it rests its pleading in part on the text of Minn. Stat. § 43A.191.[^2] Among the provisions it cites is subdivision 3(c), which requires an agency to explain the reason for hiring a non-affirmative candidate.[^2] The record gives the filing date of 14 January 2026. It does not show any later docket activity, an answer by the State, or a ruling. The case is described here as pending, and its allegations are stated as allegations.[^2]
### The Department of Justice's description
DOJ's Office of Public Affairs issued release No. 26-21 on the day of filing, 14 January 2026. The release used the word "regime" in its title for the State's affirmative-action apparatus.[^3] According to the release, Attorney General Pamela Bondi certified the case as a matter of general public importance.[^3]
The term has a settled use in federal law for governments the United States opposes. The [[Iraq Liberation Act]] of 1998 (Pub. L. 105-338) declares a policy of supporting efforts to remove "the regime headed by Saddam Hussein."[^4] The project's catalogue finds no other U.S. state described by the federal government in those terms.[^4]
### Title VII standard
In [[Ames v. Ohio Department of Youth Services]], 605 U.S. 303 (2025), the Supreme Court held that Title VII's disparate-treatment provision "draws no distinctions between majority-group plaintiffs and minority-group plaintiffs."[^5] The Court also rejected the Sixth Circuit's heightened "background circumstances" rule for majority-group plaintiffs.[^5] The record does not establish whether the complaint in No. 0:26-cv-00273 relies on *Ames*, or how the district court will apply it.[^5]
## What the record does not establish
The record contains no statement by the Department of Transportation describing the plan's purpose. It therefore offers no stated purpose to set beside documented outputs such as hiring counts, goals, or explanations filed under subdivision 3(c).[^1] The record also does not show which legislature, party or governor enacted or amended Minn. Stat. § 43A.191, or which administration adopted the 2022-2024 plan. Those signatures remain to be documented from the Revisor's history line and the plan as issued.[^2]
