# Layover Doctrine
*A label used in this project's record for a sequence in which a Minnesota body identifies a problem, the State does not prosecute or correct it, and a federal body intervenes.*
The **Layover Doctrine** is a label this project's own timeline applies to a recurring sequence in [[Minnesota]]. One timeline row compresses the pattern to "state identifies fraud, state does not prosecute, federal intervention required every time."[^1] Another uses the shorter formula "State identifies fraud. State does not prosecute."[^2] The rows apply the label to the [[Metro Gang Strike Force]] (1997–2009), the [[EIDBI]] program and [[Feeding Our Future]].[^1] No statute, court opinion or agency document in the pack defines the term. The cited sources report the individual events. The project supplies the sequence and the name that joins them.
The project's dated instances run from a 1959 martial-law declaration by a DFL [[governor]] to the FBI's January 20, 2022 search warrants against Feeding Our Future.[^7][^1] They also include a Strike Force shutdown in 2009 that the [[Minnesota Attorney General]]'s office did not initiate, according to the timeline.[^4] The timeline row for the 2022 warrants calls that event the sixth confirmation of the doctrine.[^1]
The federal government's current framing of the State appears in the [[United States Department of Justice]]'s release No. 26-21 (January 14, 2026). The release is titled *United States Department of Justice Files Lawsuit Against Minnesota's 'Affirmative Action' Regime*. In it, Attorney General Pamela Bondi certified the case as a matter of general public importance.[^6] The project's catalogue of U.S.-government "regime" usages finds no other U.S. state so described; that is the project's catalogue finding, not an independently established fact.
## What
As the project uses it, the term names three steps:
- a state body identifies fraud or misconduct;
- the State does not prosecute or correct it;
- a federal body does.[^1][^2]
The project's dossier on Orville Freeman states the same sequence as "the state acts, the state does not correct itself, and the correction arrives from a federal court."[^7] That sentence is the project's formulation, not a finding of any court or agency.
A project dossier note ties the label to [[§43A.191]] of Minnesota Statutes. The note describes the statute as one challenged in the matter at that dossier's note 2 and defended by the Minnesota Attorney General's office. The note also says the Layover Doctrine pattern is documented across the project corpus.[^5] The pack does not quote the statute's text. It does not state the docket, the court or the status of the challenge, and it does not say whether the challenge is the lawsuit announced in DOJ release No. 26-21.[^5][^6] [[Affirmative action]] is the subject named in that release's title. The pack carries no complaint text, so what the complaint alleges is not stated here.[^6]
## Who
The pack names the following actors in the episodes the project groups under the label:
- **[[Orville Freeman]]**: Minnesota's first DFL governor, who served three two-year terms (1955–1961) and lost in 1960 to [[Elmer L. Andersen]].[^7]
- **An unnamed federal court**: ruled Freeman's 1959 declaration inappropriate.[^7]
- **An unnamed commissioner**: disbanded the Metro Gang Strike Force in 2009.[^4]
- **The [[Minnesota Department of Education]]**: identified red flags in Feeding Our Future's operations in 2019.[^2]
- **Attorney General Keith Ellison's office**: the 2019 row names it as the office that did not prosecute.[^2]
- **The FBI**: executed the 2022 search warrants.[^1]
At the federal level, release No. 26-21 names Attorney General Pamela Bondi.[^6] Two White House documents from the Trump administration (January and May 2026) serve as anchors for the project's at-issue entries on the doctrine.[^8][^9]
The pack gives a party affiliation only for Freeman (DFL). It gives none for the Attorney General in office in 2005, for Ellison, or for the commissioner.[^7][^3][^2]
## When
- **December 11, 1959.** During a strike at the Wilson & Co. packing plant, Freeman declared martial law in Albert Lea. According to the Wikipedia biography cited in the project's dossier, a federal court ruled the declaration inappropriate twelve days later.[^7] The dossier presents this as the earliest documented Minnesota instance in its Freeman file. The only cited source for these dates is that secondary biography.[^7]
- **2005.** A timeline row records the Metro Gang Strike Force in its seventh year, continuing until its 2009 shutdown. Under the project's label, the row says the Attorney General "never initiates."[^3]
- **2009.** A timeline row records that the Gang Strike Force had run eleven years, that the Attorney General's office was not the initiating party in its shutdown, and that the commissioner disbanded it.[^4] The row dates the entry July 2009. The MPR News report it cites is dated August 20, 2009.[^4]
- **July 2019.** A timeline row records that the Minnesota Department of Education identified fraud red flags in Feeding Our Future's operations before COVID. According to the row, the flags were documented but not acted upon, and the Attorney General's office did not prosecute.[^2]
- **January 20, 2022.** The FBI executed search warrants against Feeding Our Future at more than twelve locations.[^1] The same timeline row records that Feeding Our Future dropped its lawsuit against the Minnesota Department of Education that day.[^1]
## How
Each source reports a single event: the 1959 ruling, the 2009 disbanding, the 2019 red flags and the 2022 warrants.[^7][^4][^2][^1] None of them states that the events share a cause. None describes a policy of state non-prosecution.
The rows' internal counts are not reconciled. The 2022 row calls that event the sixth confirmation but names three programs.[^1] It also dates the Strike Force from 1997 to 2009, while the 2009 row gives a run of eleven years.[^1][^4]
The 2005 and 2009 Strike Force entries rest on news reports, not on a primary audit or order.[^3][^4] The 2019 entry rests on a news timeline.[^2]
## In the at-issue record
The project's at-issue entry on the 1959 episode ([[At issue 005 - In 1959 Governor Orville Freeman declared martial law]]) repeats the dossier's dates. It is anchored to a January 2026 White House fact sheet on a new Department of Justice division for national fraud enforcement.[^8] The fact sheet is the entry's anchor, not a source for the 1959 events. Those events rest only on the Wikipedia biography.[^7]
A second entry ([[At issue 100 - In one hundred twenty-two years the terminal audit]]) restates the doctrine as a closing claim about Hennepin County. It is anchored to a May 2026 White House release on fraud enforcement.[^9] That entry lists court, report and statute sources at the Legislative Auditor, govinfo.gov and justice.gov domains. The pack carries none of those documents, so the entry's assertions are not stated here as fact.[^9]
## In the Minnesota record
### Where
- The 1959 declaration was made in Albert Lea, Minnesota.[^7]
- The 2019 entry is placed in Minnesota.[^2]
- The 2022 warrants were executed at more than twelve locations, which the pack does not name.[^1]
